REPORT: Biden Has Multiple Officials Working ‘Illegally’
Surprise… the Biden administration is reportedly breaking the law.
Bloomberg Law is now reporting that a federal watchdog is accusing the administration of having multiple officials that are working illegally.
There are reportedly three officials who have overstayed the “acting” limits in their positions.
That is Illegal
The Government Accountability Office is reporting numerous violations of the 1998 Federal Vacancies Reform Act, according to the New York Post.
Deidre Harrison, the acting controller at the Office of Management and Budget; Allison Randall, the acting director of the Department of Justice’s Office of Violence Against Women; and Charlotte A. Dye, the acting general counsel at the Federal Labor Relations Authority, are all performing their duties in violation of the law.
All three of them have been serving in their roles since November 2021.
The limit on serving in an “acting” capacity is 210 days, or up to 300 days after inauguration, so they are all obviously well over that limit.
Officials are permitted to stay longer if there is a permanent nomination that is pending, or a nomination has been withdrawn.
The administration has been officially notified of the violations, but there is a much bigger problem for Biden.
Over and above possible fines, any decisions or rules that were put in place after the deadline has passed can make these rules invalid.
Biden could find himself facing a slew of legal challenges, especially when it comes to the Office of Management and Budget, the office that has been very consequential thus far in this administration.
Now that Democrats have complete control of the Senate, Biden would be well advised to push through appointments before he finds himself in some serious hot water over this issue.
There were several other violations, most notably Tae D. Johnson as acting director of Immigration and Customs Enforcement, but those violations have seen been addressed and those particular positions are no longer violating the law.
